1. GENERAL CONDITIONS

  1. The tenant should use the rented property as if it was her/his own house.
  2. The tenant has to act in good faith towards his neighbors and other residents while residing in the rented property.
  3. The tenant cannot make any changes to the property without obtaining the permission of the property owner; If he/she does, he is obliged to pay the damages that will arise due to this reason.
  4. The tenant is obliged to immediately notify the owner about the maintenance and repair works on the property. Otherwise, he is obliged to pay the damage caused by this situation.
  5. The tenant is obliged to immediately notify the owner for the decisions taken about the building.
  6. The tenant is obliged to give permission for the issues to be done in line with the decisions taken about the building.
  7. The tenant is obliged to carry out maintenance operations on the property due to unusual and ordinary use. 
  8. The taxes arising from the ownership right of the property will be paid by the owner, and the taxes, expenses, duties and charges arising from the use of the property belong to the tenant. In case of conflict due to this situation, local customs will be applied.
  9. At the end of the renting, the tenant has to hand over the property to the owner as it was received before this contract. 
  10. The rented property should be delivered in the best condition and ready for next use. Problems arising from the normal use of the property will not be covered by the tenant. However, the tenant is the one that has the burden of proving that.
  11. If the property is put up for sale, the tenant must allow it to be visited by prospective buyers.
  12. The tenant cannot demand a price for the useful and luxurious things he has done on the property. When the contract expires, he can take away the things he has done, provided that he leaves the house as it was received.
  13. For the matters not settled above, the relevant articles of the Turkish Code of Obligations No. 6098 shall apply.

2. SPECIAL CONDITIONS 

  1. Rented real estate; cannot be rented, transferred, assigned or sub-leased to anyone else.
  2. The rented property can only be used as stated in the intended use in the diagram. It cannot be used for any other purpose.
  3. The tenant has to comply with any decision taken jointly by the building. Otherwise, the contract can be terminated or tenant can be evicted.
  4. Rental payments will be paid on the …………….. day of each month, …………… bank, ………………………………………….. IBAN of the owner. In case the rental fee is made by EFT from another bank, the tenant should pay attention so that it is not deposited late. Otherwise, the default provisions will find application area. 
  5. If the tenant does not pay the rent for one month, the rent for all months will be due. This situation cannot be objected to under any circumstances.
  6. While being the tenant for the property; concierge fee, building contribution fees, fuel expenses, water and electric bills, environmental tax etc. will be paid by the tenant.
  7. The property is in a painted form, at the same time; doors, windows, installations have been delivered completely and properly to the tenant.
  8. As a fixture in the property……………………………………………………………………. ………………………………………………………………………………………………. exists.
  9. The tenant has to make the water, gas and electricity subscriptions on her own behalf.
  10. The rental period is 1 year. However, unless the parties declare that they will not renew the contract at least 1 month before the end of the renting period, the rental agreement is automatically extended for 1 more year.
  11. In case of automatic extension of the rental agreement, the rental price will be increased by the average of the PPI & CPI(ÜFE&TÜFE) rate announced by TUIK and calculated according to the same month of the previous year.
  12. Tenant will pay the guarantee deposit 1 rental fee to the owner for the expenses may arise because of the wreckless use of the property. If there is no damage or expense related to the real estate when the rental agreement is terminated, this price will be paid back to the tenant. The tenant cannot in any way deduct the guarantee from the rent.
  13. With this contract, the tenant agrees to pay 1 rental commission to the real estate agent company.
  14. The liability of the guarantor is limited to a maximum of 3 (three) years and a maximum of 18 (eighteen) months of rent starting from the establishment of the rental agreement.
  15. Due to the disputes arising from the contract, the courts and enforcement offices of the place where the property is located will be authorized. (…./…./……)
